Police cannot be asked to probe case after judicial inquiry: Raj HC

Jaipur, June 18 (UNI) Rajasthan High Court has said after a magistral inquiry begins in a case, the police cannot be asked to start probing the case.

Justice G S Saraf gave the verdict in a case filed by petitioner Ishwar Singh. According to the case, Ishwar Singh had filed case under Section 420 against Bhagram in 1992 in the court of Munsif and judicial magistrate in Shivganj.

Admitting the case and after hearing the petitioner's plea, the magistrate lodged the case under section 200 of IPC. The petitioner testified as witness under Section 202.

But later the magistrate felt the need for a police probe into the case and sent the case to Shivganj police station incharge.

After the probe report was submitted, it was found that the petitioner had lodged a false complaint and discarding his petition, a case under Section 211 was lodged against Ishwar Singh.

Ishwar Singh challenged the magistrate's decision and petitioned in the High Court.

Admitting petitioner Ishwar Singh's appeal, High Court cancelled the magistrate's orders and returned the case to him, asking him to give the verdict in accordance with law.
