HC stays transfer of UP official

Allahabad, June 19: The Allahabad High Court today stayed the transfer of a deputy secretary posted in UP Higher Education Service Commission (UPHESC).

The petitioner, Sanjay Kumar Singh had been transferred from Allahabad to Dudhi, Sonebhadra district by an impugned order passed on June 5, 2007. Mr Justice S K Singh, ordering to maintain status quo, asked the state government to file a counter affidavit.

The court fixed July 4 as the next date of hearing.

Counsel for the petitioner had argued that his client was posted on deputation in the office of UPHESC at Allahabad for merely one-and-a-half month and therefore, his transfer was illegal. He contended that period of deputation of a government employee is fixed as per service rules and thus an employee can not be transferred before completion of the same.
