BMW sting: SCBA revokes suspension of Anand, Khan

New Delhi, June 19 (UNI) The Supreme Court Bar Association (SCBA) today revoked the suspension of senior advocate R K Anand and I U Khan, who were caught on camera during a sting operation conducted by NDTV, trying to influence a prosecution witness in the BMW case in which five persons were killed when they were runover by Sanjeev Nanda, grandson of former Navy chief.

SCBA, in its executive meeting, revoked the action after a three-member inquiry panel found the suspension improper as no opportunity was given to the two advocates to explain their conduct.

I U Khan was removed as special public prosecutor in the case after the exposure and high court directed its Registrar General to conduct an enquiry. The high court will consider the report of Registrar General on July two.

Delhi Bar Council has also issued notices to the two advocates who were caught on camera trying to bribe Sunil Kulkarni, the sole eye-witness in the case, by inducing him to change his statenment in return for bribe.

R K Anand was caught asking the witness to demand Rs five crores from Nanda's kin which would include his share of money.

I U Khan was also found in touch with R K Anand and the witness.

The exposure had led to huge public outcry and both the counsel are facing proceedings for professional misconduct.

SCBA president P H Parikh told UNI that the suspension has been revoked by a majority decision in the executive. He also said the two members of the committee namely V Shekhar and Vikrant Yadav gave report in favour of the two advocates recommending the revocation of the suspension while he himself was of the view that suspension of R K Anand should not be revoked while in case of I U Khan, suspension order can be kept in abeyance. SCBA executive was sharply divided on the issue. Four members opposed the revocation while others supported the revocation of the suspension.
