UP to file counter affidavit on ordinance dissolving state SSC

Lucknow, June 18 (UNI) The Lucknow Bench of Allahabad High Court today directed the Uttar Pradesh government to file counter affidavit within 10 days in a PIL challenging an ordinance dissolving the UP Subordinate Services Selection Commission.

The order was passed by a vacation bench comprising Justices Devi Prasad Singh and Allah Raham on a PIL filed by Dr Asha Ram.

The bench issued notices to state advocate general Jyotindra Mishra and fixed July 9 as the next date of hearing.

The PIL had claimed that the June 2 ordinance was a misuse of Article 213 of the Constitution by the state government.

It further mentioned that the ordinance was issued without considering the special circumstances in the matter.

Referring to previous Supreme Court judgements, former advocate General S M A Kazmi contended that the ordinance passed by the governor came under the purview of judicial review.
