Labour court orders Ambika Solvex to reinstate 36 workers

Akola, June 11 (UNI) An industrial disputes tribunal here has directed Ambika Solvex Ltd to reinstate its 36 workers to their former post till the final decision on the complaint and case be fixed for issues in the matter.

Delivering the judgment recently, Labour court judge V G Dhande observed that the services of the 36 workers in one stroke were terminated by the Ambika Solvex Ltd, situated at village Vani-Rabhapur near here, without following the mandatory provisions of the law.

It is a well admitted position on record that the company did not issue notices to the applicants (workers) to pay one month wages in lieu of them or retrenchment compensation or display seniority list seven days prior to the dates of termination of their services and follow principles ''Last come first go'', the judge noted.

Bandu Dinkar Gawande along with 35 workers had filed the complaint under section 30(2) of Maharashtra Recognition of Trade Union (MRTU) and Prevention of Unfair Labour Practices Act 1971, stating that they were appointed as workmen on wages of Rs 60 per day. However, they did not get attendance cards, leave cards and identity cards despite their frequent appeals. They were orally terminated on September 19 last year despite the workers continuously serving the company over 240 days.

In defence, Ambika Solvex alleged that the workers had committed misconduct of serious magnitude in factory premises and, therefore, the application of workers be forthwith rejected.

Observing the malafide intention and colourable exercise of the company, the judge rejected the defence plea.

Noted labour practitioner Ramesh M Rathi argued for the workers, while Advocate Kawle held the brief for the company.
