Trade union registrar barred from declaring NRMU election results

Allahabad, June 8 (UNI) Allahabad High Court today directed the registrar of trade union, New Delhi not to declare the final results of the notified election of the Central Council of Northern Railway Mazdoor Union (NRMU), scheduled on June 25.

The HC has asked the government, through general manager, Northern Railway, Baroda House, New Delhi, registrar trade union, divisional rail manager Moradabad and NRMU to file their reply in the case.

The NRMU members and voters are in eight northern states -- Uttar Pradesh, Delhi, Haryana, Chandigarh, Punjab, Himachal Pradesh, Uttarakhand and Jammu and Kashmir.

Justice Shishir Kumar passed this order today on a writ petition filed by the president of Carriage and Wagon branch of the mazdoor union of Moradabad division Yash Pal Singh.

The petitioner had challenged an order passed by administrator of the mazdoor union on May 23, whereby, he had accepted the expired voter list consisting of general body members, who were entitled to cast their vote for the Central Council Election of NRMU.

Appearing for the petitioner, advocate Rajesh Kumar Singh pointed out to the court that the order passed by the administrator was apparently illegal and contrary to the Supreme Court directives for holding the said election.

He contended the SC on September 6, 2006 had passed an order appointing the registrar, trade union, Delhi as administrator of the union for conducting the election, but the administrator in the garb of the order notified the election of the central council of the union, holding the expired voter list to be valid to caste votes in the election.
