ND: SC fixes June 18 for hearing MCD's petition

New Delhi, June 7: The Supreme Court today fixed June 18 for hearing the petition filed by the MCD against the Delhi High Court order, refusing to extend time for removing illegal constructions which are beyond compoundable limits.

A Vacation Bench, comprising Justices Arijit Pasayat and B P Singh, fixed the date after hearing counsel Sanjiv Sen for the MCD. Advocate Sen contented that until the impugned judgement of the High Court was stayed till the final disposal of the this petition, the MCD will have to carry out demolition on a large scale.

The Delhi High Court, vide its orders dated January 24 and February 14, had fixed May 31 as a deadline for those who have made illegal constructions to give an undertaking that they would demolish these themselves.

When the MCD told the High Court that the order was in violation of Master Plan Delhi (MPD) 2021 which has already been notified by the Government, the High Court directed the MCD to approach the Supreme Court as the MPD 2021 was being examined by the apex court.

MPD 2021 has set no time limit for removal of unauthorised/ illegal construtions which are even not protected by the MPD 2021 and cannot be compounded.

The Supreme Court has already banned construction of third floor and above. According to the MPD 2021, illegal constructions can be got regularised by paying compounding fees through self-assessment.
