JK: HC summon DC Kupwara in PS Act detention case
Srinagar, May 31: Taking a serious note of prosecutor's failure to produce a challan against a youth arrested under Public Safety Act (PSA) in February last year, the Jammu and Kashmir High Court has directed Deputy Commissioner, Kupwara, to present himself in person before the court on June 5.
The court order came after the prosecutor failed to produce challan in the court against Mohammad Ayub Khan despite repeated summons.
Khan was arrested by Army and Special Operation Group (SOG) of the Jammu and Kashmir police in a joint operation in Kupwara.
A case was later registered against him and on the recommendation of the Senior Superintendent of Police (SSP), DC, Kupwara, booked him under PSA.
Later, the relatives of Khan challenged the detention order through a writ petition in the high court. However, despite several hearings the government failed to file the objections.
The counsel for the detainee appealed the court to quash the detention as the prosecutor had nothing to say.
The Court has directed the DC Kupwara to present himself.
