No prior permission is required for medical reimbursement: HC

Jaipur, May 17 (UNI) The Rajasthan High Court has ruled that in the case of medical reimbursements, the formality of obtaining prior permission for the treatment could be ignored in certain emergency case.

Justice Ashok Parihar of the High Court issued the order in a petition filed by one Pawan Sharma.

Pawan Sharma is a government employee posted at Community Health centre, Laxmangarh in Sikar district. He had to be admitted to the Escort Heart Institute, New Delhi after he suffered a heart attack and had to undergo a bypass surgery to remove the blockade. The hospital bill amounted to Rs 2.11 lakh.

When he submitted the medical bills for reimbursement, the government did not reimburse the bill by pointing out that he had not obtained prior permission for the treatment at Escort Heart Institute and the complianant approached the court.

The court observed in its order that ''the technicalities and necessities of certain prior permission should always be ignored in such matters. Emergency sees no laws. The main concern of the patient at that perticular moment is to save his life and not wait for the necessary formalities.'' The court orderd the government to reimburse the entire bill and pay an additional amount of Rs.20,000 for the cost of litigation.
