SC issues notices to UP and Delhi govt on Vikas Yadav writ

New Delhi, May 14 (UNI) The Supreme Court today issued notices to the state of Uttar Pradesh and Delhi government on a petition filed by Vikas Yadav, main accused in the Nitish Katara murder case, seeking his release on bail.

A bench comprising Chief Justice K G Balakrishnan and Justices R V Raveendran and Lokeshwar Singh Paonta, issued notices after hearing Senior Counsel K T S Tulsi, who contended that his client is suspected to have contacted Tuberculosis(TB) during his stay in jail and jail doctors report has expressed a suspicion that Vikas may be suffering from TB.

Mr Tulsi contended that he was only asking for the proper medical check-up of his client to find out whether he was really suffering from the dangerous disease. Counsel for the complainant, Kamini Jaiswal, however, contended that Vikas has been raising this bogus plea for delaying the trial for the last two years.

Vikas, son of former Rajya Sabha member D P Yadav, has taken five days in recording his statement before the trial court. Jaiswal also brought to the notice of the court that Delhi government has not been made a party deliberately despite the case having been transfered to Delhi and prosecution is being conducted by Delhi government.

The court directed the petitioner to implead Delhi government as a party in the case and adjourn the hearing till the second week of July.
