Court respite to Varanasi DIG

Muzaffarnagar, May 10 (UNI) Giving respite to the Varanasi DIG Rajendra Pal Singh in Rampur Tiraha case, the District Court today put aside the lower court order which had directed that the legal proceedings should be initiated against government servants without approval of the Uttar Pradesh government.

On October 2, 1994, demanding separate Uttarankhand state, large number of demonstrators were enroute to Delhi. To control the mob, the police opened fire at Rampur Tiraha here, killing several people.

Mr Singh was Muzaffarnagar SP at that time. He along with Chappar police station in charge Rajbir Singh misrepresented facts in the General Diary (GD).

After investigating the case, CBI had filed chargesheets against the duo. However, the state government refused to give permission for Mr Singh's trial.

In February 2007, Additional Chief Judicial Magistrate (I) Pyush Pandey had directed that under section 197 of CrPC, the state government's permission is not necessary to initiate legal proceeding against government officials.

Mr Singh had challenged the lower court judgement in the district court.

Hearing the case, District Court judge R D Nimesh said since the UP government did give permission for Mr Singh's trial, the lower court's judgement must be put aside.

The court directed the lower court to go through today's order and hear the case again.
