Survey before notifying fresh roads in residential areas: SC

New Delhi, May 7 (UNI) The Supreme Court today directed that no fresh road in Delhi shall be notified, permitting commercial activity in residential areas without conducting proper survey.

A bench comprising Justices Arijit Pasayat, P K Balasubramanyan and D K Jain also directed that no construction beyond two and a half floors shall be permitted.

The court also directed that commercial premises in NDMC area which are not protected by Master Plan Delhi 2021(MPD 2021) shall also be sealed.

The court also directed Delhi government, DDA, Delhi Jal Board, MCD and NDMC to file detailed report on how and when basic amenities like water, electricity, parking, road, schools etc, shall be provided to make the new master plan feasible and workable in the city.

Adjourning the hearing till July 23, the court observed mere construction of houses is not sufficient and these houses should be worth living also.

The court also fixed July 14 for hearing of the interlocutory application.

The new master plan notified by the government seeks to regularise around 1500 unauthorised colonies spread all over the city besides protecting all illegal constructions which had taken place in the city upto December 31, 2006.

The Residents Welfare Associations(RWA) are however opposing the new master plan alleging that it gives a free hand to land mafia, land grabbers and builders to carry on their notorious activities and RWAs have been totally left out in the cold.
