DTC Chairman summoned for non-compliance of court order

New Delhi, May 1 (UNI) The Delhi High Court has summoned the Delhi Transport Corporation(DTC) Chairman to be present in the court on May 10, 2007 for non-compliance of a judicial order directing it to pay the pensionary dues of a retired employee.

Justice S Murlidhar said, ''It is not open to the DTC Chairman to unilaterally decide to avoid compliance with the binding orders of this court. Worse still, the application seeking exemption is supported by the affidavit of the Deputy Chief General Manager, DTC.'' ''The court takes a serious view of the attitude of the DTC Chairman in presuming that by merely filing this application he can stay away from the court,'' said Justice Murlidhar, while hearing the exemption application.

While dealing with the judgement pronounced on August 11, 2006, the Court had directed DTC Chairman Anshu Prakash to be present in the court on April 30 if the order to release the pensionary benefits to retired employee Satya Pal Singh was not made.

The court had said in its previous order, ''If compliance affidavit is not filed on or before April 30, 2007 along with pension fixation order, Mr Prakash will be personally present in the court.'' The DTC Counsel submitted that a special leave petition had been filed in the Supreme Court but he failed to produce a copy.

The Court directed the DTC to deposit the whole amount due to the petitioner with the court within one week, which would be released after outcome of the petition filed in the Apex Court.
