Charges framed against ex Noida CEO, others in land bungling case

New Delhi, May 1 (UNI) Former Noida CEO Neera Yadav and her deputy are among several persons against whom the Court of Special Judge, Ghaziabad, today framed charges in connection with three cases of bungling in allotment of land in the industrial town.

Special Judge (Anti-Corruption - UP (East) - Ghaziabad) Ms Rama Jain framed the charges against them on three chargesheets filed by the CBI.

While the first chargesheet was filed against Neera Yadav, former Chairman-cum-Chief Executive Officer of NOIDA and her deputy for alloting land to herself and her two daughters u/s 13(1)(d) r/w 13(2) of P.C. Act, 1988, the second was against Neera Yadav and her then deputy Rajiv Kumar, also an IAS, in connection with the allotment of land to him u/s 120-B IPC r/w 13(1)(d) r/w 13(2) of PC Act, 1988.

The third chargesheet was also against Neera Yadav and Mahesh Sharma, CMD of Kailash Hospital in Noida for allotment of land to the hospital u/s 120-B IPC r/w 13(1)(d) r/w 13(2) of PC Act, 1988.

The CBI had registered a case against the accused January 1998 orders of the Supreme Court based on a Writ Petition filed by NOIDA Entrepreneurs Association alleging largescale bungling in allotment of land in NOIDA.

On completion of investigation seven chargesheets were filed by the CBI in the court of Special Judge, CBI, Ghaziabad and two in the court of Special Magistrate for CBI cases, Ghaziabad.

Presently, of the seven cases, five cases are pending trial, of which four are in the court of Special Judge, CBI and one in the court of Special Magistrate.

Ms Yadav, former NOIDA CEO, appears as accused in all the four cases pending trial in the court of Special Judge.

These four chargeshets were filed during October, 2002 by the CBI alleging criminal acts on the part of the said former CEO and others in the allotment of land to the said former Deputy CEO, to a hospital centre to a group of companies and to two daughters of the former CEO.

The Special Judge, Ghaziabad had passed an order on April 27, 2004 for framing the charges against all the accused in all the four cases, following which Ms Yadav and others filed a revision petition in the Allahabad High Court.

The High Court later dismissed the petitions on January 25, 2006 and passed an order saying that once sanction u/s 19 of the PC Act, 1988 is granted, there is no necessity for obtaining further sanction u/s 197 of CrPC.

Subsequently, the former CEO challenged the order of the High Court on January 25, 2006 in the Supreme Court through an SLP.

After its July 7 hearing the Supreme Court passed an ex-parte order staying the proceedings in all the court cases relating to the land allotment pending before the court of Special Judge, Ghaziabad.

However, later the SLP was withdrawn on January 22 this year.
