HC reserves order on PIL seeking prosecution of Jaya

Chennai, Apr 26 (UNI) Madras High Court today reserved orders on a Public Interest Litigation (PIL), seeking a direction to the Election Commission (EC) to initiate appropriate action by launching prosecution against former Tamil Nadu chief minister J Jayalalithaa, for allegedly making a false declaration, while filing nomination in four Constituencies during the May 2001 Assembly poll.

A Division Bench comprising Justices Dharamarao Elipe and S Palanivelu reserved orders on the PIL filed by DMK MP C Kuppusamay, who sought to direct the EC to initiate action by launching prosecution against Ms Jayalalithaa for the offence alleged to have been committed under Section 177 of IPC directly, control and monitor the same under the powers of judicial superintendence in confirmity with Section 33 (7) (b) of the Representation of Peoples Act.

The Bench reserved orders after hearing elaborate arguments from senior counsel R Shanmughasundaram, appearing for the petitioner, senior counsel G Rajagopal, appearing for the ECI and N Jyothi, counsel for Ms Jayalalithaa.
