Sushil Sharma challenges HC judgement in Naina murder case

New Delhi, Apr 19 (UNI) Former Delhi Pradesh Youth Congress president Sushil Sharma today challenged in the Supreme Court the Delhi High Court judgement upholding the death sentence awarded to him in Naina Sahni Tandoor murder case.

Sharma, in his appeal, has contended that the present case does not fall in rarest of the rare category.

The trial court had awarded Sharma death sentence for killing his wife Naina in 1995 in Gol Market area, whose body he later tried to dispose off by burning it in the kitchen of his Bagia Restaurent in Ashok Yatri Niwas Hotel Complex.

Later, Sharma was arrested from Bangalore. His manager, Keshav, was also arrested for helping him in disposing off Naina's body.

Sharma suspected that his wife was having illicit relation with one Maqbool, a Congress activist.

The High Court had confirmed the death sentence and had dismissed his appeal.

In his petition, Sharma, also contended that both the trial court as well as High Court have failed in appreciating the entire evidence in the case in correct perspective.

According to the petitioner, prosecution had failed to establish and prove the case against him beyond all reasonable doubt and the chain of events is also not complete. Therefore, Sharma is entitled to acquittal.

He has also prayed for stay of his execution till the final disposal of his appeal.

The petitioner has prayed to the Apex court to set aside the judgements of the trial judge G P Thareja and that of Delhi HC.
