Suspended SP seeks stay of departmental probe against him

Chennai, Apr 18 (UNI) Suspended Superintendent of Police P K Premkumar today moved the Madras High Court, seeking to stay all further proceedings in the Departmental enquiry initiated against him pursuant to the charge memo issued by Tamil Nadu Home Secretary.

Justice K Chandru, before whom the petition filed by Premkumar came up for hearing, referred the matter to the Registry, to place it before the Chief Justice for posting it before some other judge.

In his petition, Premkumar also sought to quash an order dated March 28, 2007 issued by Uma Ganapathy Shastri, IGP vigilance and anti-corrpution and enquiry officer and to direct him to send the documents stated in the chargememo to the State Forensic Science Laboratory for expert opinion.

He submitted that while he was being examined medically at General Hospital on September 4, 2006, by some strange coincidence,Ravi Subramanian, approver in the murder case against Seer of the Kanchi mut Jayendra Saraswathi and his junior Vijayendra, was brought for treatment to the same outpatient department.

On September 8, 2006 by an order of Home department, he was placed under suspension on the ground that an enquiry into certain grave allegations was contemplated. He made a number of representations seeking the reason for suspension but there was no response, he submitted.

On November 23, 2006 a chargememo was framed stating that on September 4, 2006 he unauthorisedly gained access and met the accused Ravi Subramanian, approver in Sankararaman murder case, who was in judicial custody and under treatment at GH, and offered inducement and threat to escape from custody with a view to bring disrepute and embarassment to the state government, he submitted.

By the said act, he had failed to maintain absolute integrity and devotion to duty and thereby he had contravened Rule 20 (1) of the Tamil Nadu Government Servants Conduct Rules, 1973,the memo added, he said.
