HC takes stern view of non-compliance of order

Allahabad, Apr 18 (UNI) Allahabad High Court expressed displeasure and dissatisfaction ones the explaination of the Uttar Pradesh government which said that it was due to state assembly poll and change of officers that the sanction for prosecution of cases against police and non-police servants have not been made.

A bench comprising Justices Imtiyaz Murtaza and Amar Saran has now directed that by May 15 there shall be positive compliance of 893 cases of police and non-police public servants, whose arrests were said to be pending because of want of sanction.

Passing the order on a writ petition filed by Sandeep Kumar Yadav, the HC directed that in the event of any non-compliance of the March 12 and February 20 orders passed by the bench, the DGP, DG CB-CID and the principal secretary home, shall appear in person in the court on May 15 to explain their stand.

Advocate general S M A Kazmi on February 20 had given an undertaking to the court that its earlier orders shall be complied with before March 31, 2007.

He had said that an order has also been passed in this connection by the principal secretary home directing all the secretaries, DGP and DG CB-CID to dispose of all the pending matters before March 31.

Mr Kazmi submitted that his undertaking was based on instructions received by him from the concerned officers and the non-compliance was due to UP election and of change of guard -- the principal secretary home and DGP etc.
