HC declines to stay Single Judge's order on BPCL issue
Chennai, Apr 17 (UNI) Madras High Court today declined to stay the order of a Single Judge, dismissing a petition filed by Bharat Petroleum Corporation Limited (BPCL), seeking to declare the strike notice issued by the Petroleum Employees Unions, proposing a strike on April 18, as illegal.
A Division Bench comprising Chief Justice A P Shah and Mr Justice D Murugesan declined to stay the order of a single judge, while hearing an appeal filed by BPCL.
The bench however said, the Unions should strictly follow other condititions including the one that they should not prevent the employees who are willing to work.
The Single Judge had on April 16 dismissed the petition filed by BPCL seeking to declare strike notice dated March 30, 2007 issued by Petroleum Employees Union, Petroleum Workers Union and Petroleum Employees Association, as illegal and violative of section 23 of Industrial Disputes Act, in view of the fact that proceedings are pending adjudication of issues relating to quantum of Performance Linked Incentive Scheme.
