SC angry over orders not being carried out
New Delhi, Apr 11: The Supreme Court today expressed deep anguish over the fact that its orders were not being carried out by the Delhi Police and the Municipal Corporation of Delhi (MCD) in letter and spirit.
A bench comprising Justices Arijit Pasayat, C K Thakker and Lokeshwar Singh Panta found contradictory the affidavits submitted by Delhi Police Commissioner K K Paul and MCD commissioner Ashok Kumar Nigam, who were personally present in the court.
The court observed that the authorities were not interested in the sealing operations in the capital.
The Apex court, while expressing hope that from now onward its orders will be implemented in letter and spirit, observed, ''It is a petty matter we never intended to have the officials here for as they have other work to do. This is not the way you function.'' ''It is unfortunate. We again express our anguish as our orders were not carried out in true spriti. The authorities are not interested in the sealing operations. We are pained.
Some sanctity must be attached to our orders.'' Delhi Police Commissioner in his affidavit told the Apex court that force could not be spared earlier due to SAARC summit and MCD elections as the borders of the national capital had to be sealed.
The police chief assured the Apex court to obey its orders and directions in future sincerely.
MCD Commissioner, however, blamed Delhi Police for not providing adequate force for the sealing operations.
The Apex court had directed the authorities to continue sealing operations in respect of those commercial premises that are not covered by the Master Plan Delhi(MPD) 2021. The Apex court has also made it clear that it has not given any protection to encroachers and land grabbers.
The Apex court yesterday sentenced former Delhi Industries Minister and BJP MLA from Hari Nagar, Harsharan Singh Balli to three months' imprisonment for breaking seals of the premises which were sealed under the orders of the Apex court.
