All party meeting refuses to accept notice issued against MLAs
Jaipur, Apr 6 (UNI) An all party meeting held here today in the back drop of Rajasthan High court issuing notice to four MLAs and assembly secretatry for disparaging remarks against the judiciary in the house has decided not to respond to notice by the MLAs and the Assembly secretary.
Briefing newspersons after the meeting Rajasthan Assembly Speaker Sumitra Singh said ''the MLAs have excecised their rights bestowed on them under 194 of the constitution and the court have no business to intervene in the matter''.
''We have full respect of the judiciary but the judiciary also excerise their powers within their limits,'' the Speaker said.
She said even if the MLAs have violated the Article 211 of the constitution the enquiry falls outside the scope of proceedings in a court. She said the presiding officer of the house is the supreme authority with regard to the regularity or otherwise of the proccedings.
Justcie Ashok Parihar of the High Court had issued notices to the MLAs through its secretary against ruling BJP MLAs Nathu Singh Gujjar and Madan Rathore and Oppostion Congress MLAs Durga Prasad Agarwal and Mohammad Mahir Azad on a petition moved by a lawyer Amit Gupta seeking initiation of contempt of court proceedings againt the four MLAs who cast aspersion while participating in the house debate on March 20.
The court issued notices returnable within a month made state chief secretary and advocate general as respondents in the case.
