Court directs INLD leader Indora to vacate land and pay rent

Fatehabad, Mar 22 (UNI) A local court has directed Dr Sushil Indora, Deputy Leader of the Indian National Lok Dal (INLD) in the state assembly, to vacate a piece of land under his possession and also pay rent for the period he had been occupying the property illegally.

Additional Civil Judge (Senior Division), Fatehabad, Sushil Kumar Garg delivered the ruling on a plea by Om Parkash, a local resident, who had moved the court on May 4, 2005 seeking possession of his plot measuring 16 marlas situated in Basti Bhiwan of Fatehabad town.

The plaintiff had alleged in his plaint that the defendant Dr Indora, MLA from the Ellenabad assembly constituency, had forcibly occupied the plot using his political clout.

Dr Indora was a Member of Parliament at the time of forcible occupation and his party the INLD was in power in the state.

Prakash had alleged that though he had reported the matter to the police and also the higher authorities, his complaints fell on deaf ears.

In his reply submitted to the court, Dr Indora had maintained that he had been in adverse possession of the plot for more than 12 years without any resistance from any quarter, including the plaintiff, and had thus 'perfected his title'. He also raised some technical objections to the suit like the plaintiff had not paid proper court fees.

In support of his case, the plaintiff submitted receipts of telegrams sent to various authorities, while his plot was being encroached upon. He also produced copies of local newspapers showing news relating to the incident published in those.

The court, while decreeing the suit in favour of the plaintiff, directed Dr Indora to vacate the plot within two months after removing all encroachments, failing which the plaintiff will have the right to get it vacated through court and would become owner of the construction too.

The court also directed the MLA to pay Rs 2000 per month as rent for the period during which the plot has remained under his possession.
