House panel recommends guidelines to streamline GB institutions

Itanagar, Mar 17 (UNI) In a far reaching implication, a thirteen-member House Committee headed by J K Panggeng on the justice delivery system prevalent in the traditional method of the institution of Gaon Burahs (GBs) recommended guidelines to strengthen the institution in its 15-page report presented in the Assembly yesterday.

Considering the necessity of strengthening the GBs or the village authority, constituted during erstwhile North West Frontier Agency (NEFA) under the provisions of sub-rule (1) of rule 5 of the Assam Frontier (administrative justice), 1945 (Regulation No 1 of 1945), to improve their functioning in delivering justice to the litigants.

The Assembly had constituted the committee on September 23, 2005.

Suggesting a mechanism to improve the delivery justice considering the prevailing state of affairs, the report advocated suitable amendment of the above regulation by inserting the system of recording the proceeding of the village authority in writing.

The GB is synonymous with village authority or council though not mentioned in the regulation.

Citing each family member becoming GB of the village and some villages having 100 GBs, the report outlined a detailed guideline for the composition of the village authority or council, the manner of discharging the powers and the responsibilities. Right from criteria and method of appointment to their disqualification or dismissal found place in the recommendations.

While at least one-third of total adult members of a village could move no confidence motion against a GB to the deputy commissioner, a GB with below 60 per cent attendance maintained by the administrative officer in a calendar year may be show caused before his removal.

Moreover, on attending age of 70 or failure to submit medical fitness report after attaining 65 years of age, poor performance, indulgence in communal and religious activities, canvassing during election, showing favouritism, involvement in criminal case or mortal turpitude were some of the 20 grounds for eliminating dead woods GBs, the report added.
