Surupsing Naik moves HC against SIC order

Mumbai, Mar 14 (UNI) Former Maharashtra Forest and Environment Minister Surupsing Naik today moved the Bombay High Court against a State Information Commissioner (SIC) order directing the J J Hospital to provide all medical documents pertaining to his treatment while he was undergoing imprisonment for contempt of court.

A Division Bench of Justices F I Rebello and R M Sawant directed the hospital authorities to produce all the documents before the court. The state government has also been directed to inform the court whether the notice, required under the RTI Act, was issued to Surupsing or not, as he has contended that no such mandatory notice was issued to him.

Surupsing's counsel, while challenging the SIC order, urged the court to decide whether the so-called public interest in the matter prevails over the right to privacy of his client. He contended that the SIC order was passed presuming that there might have been dereliction of duty on part of jail and medical authorities concerned and that there was no provision for such presumption in the RTI Act. The matter will now come up for hearing on Friday.
