SC did not disqualify remaining 24 BSP MLAs: HC
Allahabad, Mar 11 (UNI) The Allahabad High Court has given a detailed judgement in the case of the remaining 24 BSP MLAs, holding that the apex court in Rajendra Singh Rana's case had declared only 13 party MLAs as disqualified.
The bench comprising Justices A Kumar and Dilip Gupta said as far as 24 BSP MLAs are concerned, the Supreme Court has not declared them disqualified.
The bench passed the judgement on a writ petition filed by S P Goswami, former student leader of the Allahabad University (AU) and another person.
The petitioners had filed the writ petition seeking disqualification of the 24 MLAs and also restraining them from their participation in the proceedings of the Assembly.
The petitioners counsel Shailendra, while interpreting certain paragraphs of the SC judgement dated February 14, 2007, has sought issuance of a writ of quo-warranto against the remaining 24 MLAs restraining them from their participation in the proceedings of the house.
On the other hand, the opposite counsel questioned the ntainability of the petition, basing his arguments mainly that the judgement of the SC can not be sought to be clarified under Article 226 of the Constitution of India.
Dismissing the writ petition, the HC said none of the arguments of the petitioners counsel can be accepted.
