Orissa HC directs DGP Mohanty to surrender before CJM Jaipur
Cuttack, Mar 1 (UNI) The Orissa High Court today directed state DG (Home Guard and Fire Services) B B Mohanty to surrender before the Chief Judicial Magistrate, Jaipur for bail in connection with the case lodged against him by Lalkothi Police station for allegedly abetting his son, convicted in Alwar rape case, to jump parole on December 4.
Justice L K Mohapatra, who disposed of the anticipatory bail application of Mr Mohanty, directed the petitioner to surrender before the CJM within six weeks from today for bail.
The judge ordered that during the transit period if the petitioner is arrested, he should be released by the arresting officer on furnishing of bail bond of Rs 10,000 with one surety of the like amount to the satisfaction of the arresting officer.
The DGP had moved the Orissa High Court on January 16 last for anticipatory bail, apprehending that he might be arrested by the Rajasthan police in connection with the jumping of parole by his son Biti Mohanty, convicted and sentenced to seven years jail for raping a German woman.
The court had initially granted interim protection to Biti Mohanty from being arrested by the Rajsthan police while calling for the case diary and other records in connection with the case.
The interim protection was later extended thrice to February 26.
On February 26, Justice Mohapatra reserved his judgment on the anticipatory bail petition of Biti and ordered the interim protection granted to the DGP would stand till the pronouncement of the judgment.
The DGP in his bail petition had challenged the FIR filed by the Lalkothi Police station in Jaipur in connection with the jumping of parole by his son.
