Notice issued to Central Bank of India

Bangalore, Mar 1 (UNI) The Karnataka High Court today issued notices to the Central Bank of India on a writ petition, challenging the Debt Recovery Tribunal order dismissing a petitioner's application seeking to set aside the sale of her house and defer auction proceedings until the Lok Adalat cleared the matter.

Mr Justice Abdul Nazeer also granted an interim order, directing the aution purchaser not to damage or demolish her house in V V Puram here.

The petitioner, Vimala, a house wife, contended that the bank had obtained a decree against her before the Tribunal without issuing notice to her. The bank had obtained an order for sale of her property for recovery of the loan amount, allegedly due from her family amounting to about Rs 33,50,000. In an appeal before the High Court, she was directed to approach the Lok Adalat for appropriate relief and accordingly she had filed an application under the provisions of the Legal Services Authority Act.

The petitioner further contended that she was directed by the Lok Adalat to seek the Tribunal to defer proceedings before it. She had obtained an interim order from the Tribunal not to hand over the property to the auction purchaser. However, the Tribunal had now dismissed all her applicatons and vacated its interim order. When she was in the Lok Adalat, the auction purchaser, allegedly in collusion with the bank officials, had dumped her belongings outside and locked the premises. She apprehended that the house might be demolished, she submitted.
