Orissa HC reserves anticipatory bail of DGP Mohanty
Cuttack, Feb 26 (UNI) The Orissa High Court today reserved the anticipatory bail plea of Director General of Police (Home Guard and Fire Services) B B Mohanty and ordered that interim protection granted to him from being arrested by the Rajasthan police will continue till the pronouncement of the judgment.
Justice L K Mohapatra, who also heard the writ petition of the DGP challenging the FIR filed by the Lalkothi Police station in Jaipur in connection with the jumping of parole by his son Biti Mohanty, convicted and sentenced for raping a German woman, posted the matter for March 26.
Mr Justice Mohapatra, who had granted interim protection to Mohanty till February 26, after hearing the argument submitted by Rajasthan Additional Advocate General R S Rathore on February 15, observed that the interim protection granted to him would stand till the pronouncement of the judgment.
While arguing against the anticipatory bail petition of the DGP in the High Court, Mr Rathore submitted that the case was ''peculiar'' and did not warrabt anticipatory bail, especially judging the conduct of a senior IPS officer in abetting his son jump parole.
Mr Rathore said they had provided sufficient evidence to the court to confirm that the DGP had released his son on parole bond by furnishing all necessary document. He also argued that the commission of the offence was committed on November 20, the day the DGP's son was granted parole and stated that Biti Mohanty had been absconding since November 20 as he was not permitted to move out of Jaipur after his release on parole by the DGP.
