A bench comprising Justices B N Agarwal and P P Naolekar issued notices to Sita Devi and the other respondent, who had filed a complaint when a foreign body was found floating in a bottle of Thumbs Up on June 5, 2004.

The petitioner, who has lost the case throughout, had contended before the apex court that it was not clear whether food substances including beverages can be only tested by an authorised laboratory prescribed under the PFAA.
