UP Governor should recommend dismissal, says BSP
New Delhi, Feb 17: Reacting to media reports about Uttar Pradesh Governor, TV Rajeswar, apprising the Centre about the political developments in the state following disqualification of 13 BSP MLAs, the party today said the Union Government should lose no time in recommending dismissal of the Mulayam Singh regime.
''If the Governor fears, as per the reports, that horse trading might take place, he should not hesitate sacking the Samajwadi Party-led government in the state,'' Party General Secretary, Satish Misra, told sources here.
The two page report, sent by the Raj Bhawan this morning, describes in detail the recent political development and views of different political parties including Congress, BJP and BSP on the SC ruling.
However, according to sources, it falls short of recommending dismissal of the government.
Mr Misra said the ground on which the apex court disqualified the 13 BSP MLAs, applies to rest of the MLAs and they also stand disqualified, which means that the Mulayam Singh Government which had been supported by these MLAs was illegally constituted.
''The legal position is crystal clear and should leave no one in doubt about the unconstitutionality of the existing government in UP,'' he said.
The state Assembly has at present 403 members.There are two vacancies. The Mulayam government enjoyed the support of 210 MLAs, 152 of Samajwadi Party, 33 of Loktantrik Bahujan Dal (LBD), two of Loktantrik Congress Party, six unattached members, one CPI(M) member and 16 Independents.
During the vote on motion of thanks to the governor's address on January 25 last, eight BJP members, two members of the RLD and three of the BSP had voted in support of the government, giving the government a support of a total of 233 Members.
However, the effective strength of the Assembly has now been reduced to 388 after the disqualification of 13 breakaway BSP members and divesting of seven members of their voting rights as per the court order.
The Mulayam Singh government has 152 members of the SP, 20 of the Loktantrik Bahujan Dal, six unattached members, two of Loktantrik Congress Party, one of CPI(M) and 16 independents, which totals to 197, which is five more than the 192 required for a simple majority.
But the government may have trouble if the 20 MLAs of the LBD were also deemed disqualified in the light of the Supreme Court verdict. If that happens, the Mulayam Singh government wil be left with just 177 members in a house of 362, where a simple majority would require 182 members.
