Maternity leave lawful for women employed on sympathetic grounds:HC
Jaipur, Feb 16 (UNI) In a significant decision, Rajasthan High Court has said women, who get employment on sympathetic grounds, have the right to maternity leave.
The decision was taken by Justice A K Rastogi after hearing the petition of Kamlesh Gupta.
Kamlesh's counsel ChandraPrakash Sharma told the court that Kamlesh was employed as a second grade nurse at Mahila Chikitsalay at Chandpole in Jaipur out of sympathy.
She was denied maternity leave eiting the 1951 Rajasthan Administrative Services rules where there's no provision of maternity leave for women employed on sympathetic basis.
After hearing Kamlesh's petition, the court said there should no differentiation in the case of maternity leave for women, whether she has been employed on sympathetic grounds or otherwise.
Admitting the petition, the court directed the state government to that full maternity leave be granted to Kamlesh cancelling the orders where the petitioner had been denied leave.
