SC directs Allahabad HC to decide on Dubey suspension
New Delhi, Jan 31 (UNI) The Supreme Court today directed the Allahabad High Court to decide within four weeks the representation made by former legal advisor to Uttar Pradesh Governor B K Dubey against his suspension.
The refusal of the Governor not to relieve Dubey despite the request of the High Court had led to an open confrontation between the Allahabad High Court Chief Justice and state governor T Rajeswar Rao .
Dubey had been legal advisor to the governor for the last 12 years. He was suspended, and presently he is District Magistrate, Ballia, under suspension.
A Bench comprising Chief Justice K G Balakrishnan, Justice Dalveer Bhandari, Jus D K Jain adjourned the matter for six weeks.
The court, however, made it clear that it was both ways but the attitude of the Governor towards the High Court was offending.
The counsel for the Uttar Pradesh government sought more time to settle the issue as the meeting of administrative commiteee of High Court could not be held due to transfer of the Chief Justice to some other High Court.
