Sealing: SC must dismiss Centre, MCD applications
New Delhi, Jan 27: Delhi Pradesh Citizen Council (DPCC) has appealed to the Supreme Court to dismiss the applications of the Centre and the MCD seeking modification to the apex court orders on the issue of sealing of commercial premises operating from residential areas in the capital.
The DPCC, which represents Resident's Welfare Association (RWAs), in its application has contended that the Master Plan 2021 prepared by the government has totally ignored the interests of the residents of the city and even their constitutional rights have been overlooked.
The Council also alleged that the two applications amount to contempt of the court as the government was trying to backout from the undertaking given to the court earlier.
The two impugned notifications dated September 7 and 15, 2006 had permitted commercial use of residential premises along 2183 roads in Delhi to ''upset and nullify'' the orders of the court.
The apex court in its order dated September 29, 2006 and October 18, 2006 had allowed those traders to continue till the final disposal of these petitions. The traders are protected by the two impugned notifications subject to the condition that they will file affidavits of undertakings latest by January 31, giving an undertaking that they would seize commercial activities immidiately if the two notifications are invalidated by the court.
Traders have filed a very few affidavits this time, hoping that the Master Plan will be notified by the government and the MCD has already sought extension of time till March 15 for filing of affidavits. Sealing is due to start from February 1, while the two applications are coming up for hearing on February 2.
