SC dismisses 3 petitions for CBI probe into Nithari

New Delhi, Jan 19: The Supreme Court today dismissed three petitions on the Nithari killings -- two of them seeking a CBI probe into the horrendous crime.

A bench comprising Justices B N Agarwal and P P Naolekar dismissed the petitions as ''infructuous'' since the CBI was already investigating the case. Action has already been taken against the erring personnel of the Noida police and nothing survived in the petition.

In this rush of PILs, the main loser was the father of a 13-year-old boy who went missing and his petition was dismissed.

The court also declined the prayer, made in two PILs, seeking that the apex court monitor the investigations.

The court said that no monitoring was required by it as the investigation was already being undertaken by the CBI, and as such, it was not inclined to interfere with the ongoing process.

The Supreme Court also declined the petition of the Akhil Bharatiya Dalit Mahila E F S Samiti for laying guidelines that an FIR must be registered into cases of missing children.

The CBI has already confirmed the deaths of 22 children by the two suspects -- Moninder Singh Pandher and his servant Surendra Koli -- who are both in police custody and are being interrogated.

The CBI also made it clear that in the case the involvement of any police official was found in the crime, separate cases would be registered against such individuals.
