HC urged to cancel registration of 150 housing societies
New Delhi, Jan 19 (UNI) The Court-appointed Committee today submitted before the Delhi High Court that the registration of 150 Cooperative Group Housing Societies, which were not allotted land by the DDA, should be cancelled as most of them were in the clutches of builder mafia.
Submitting the report before a bench headed by Justice Swatanter Kumar, the Committee said these housing societies should be liquidated as they did not function according to the provisions of the Delhi Cooperative Act.
The Committee comprising Registrar Cooperative Societies(RCS) Sat Gopal, CBI DIG A K Malhotra, CBI Joint Director S C Sinha and DDA Land Commissioner Asma Manzar also sought the direction for the cancellation of the land alloted to 21 societies for alleged illegal activities by their managing committee.
The builders and the managing committee of these societies should be asked to refund the money with seven per cent interest to the members, said the report.
The original members of these 21 societies should be accomodated in the 80 societies which had already been allotted land and construction was at different stages.
Out of these 80 societies, people were staying in 16 societies and rest 64 were under construction.
While seeking permission for draw of lots, the Committee said the Court should give permission to the societies to allot flats to the members who had been waiting for several years.
The members of these 64 societies should be asked to submit the details about their membership before the draw of lots.
To ensure a smooth running of the societies and get them out of the clutches of the builders, the managing committee should be replaced by the Administrators, said the CBI.
The Committee submitted a list consisting 18 societies-- Alankrit, Neel Gagan, Sarva Kalyan, Sarvottam, Sri Ram Dev, Shahnaaz, Shan Youth, Indian Stastistical, Ashrya, Safdarjung, New Anamika, Palwell, Uttar Bharat, Living Joint, Lok Priya Vihar, Bank Men, Shantanu and Sheel-- which were yet to be given the possession of land by the DDA.
While adjourning the matter till January 31, 2007, the Court said the three separate authorities-- CBI, DDA and RCS-- to act independently and take action against the persons who had resorted to any criminal wrongdoing.
It was alleged that many of the societies had been hijacked by the builder mafia by purchasing the societies or replacing the original members of the governing body and selling the flats at an exorbitant price.
