TADA Court dismisses intervening application against Dutt

Mumbai, Jan 18 (UNI) The designated TADA Court today dismissed an application filed by an intervenor (whose identity is not to be disclosed as per court direction) expressing distrust in the prosecution and investigation agencies concerning Bollywood actor Sanjay Dutt, accused in the 1993 serial bomb blasts case.

Before dismissing the application, designated Judge Pramod Kode said he would take the decision regarding the application only after hearing the defence and the prosecution's submissions.

While Special Public Prosecutor Ujwal Nikam told the court that he did not find any whisper on propriety or integrity aimed against the State agencies, he had nothing to say if the court wanted to take the application on record.

But, he also submitted that the application would not have any concern with the matter of Sanjay Dutt, else he apprehended a floodgate of accusations delaying the case.

Defence counsel V R Manohar, too, agreed with the prosecution while submitting that such applications could only be filed by the aggrieved party.

Judge Kode finally stated in his order that it would be difficult to entertain such an application as it would be outside the law.

Also, it would lead to an endless delay in the proceedings and bringing the case to conclusion.

He said while Mr Nikam was adequately guiding the law, if such application was entertained, more would be filed tomorrow.
