Senior most doctor will be CMO: HC
Allahabad, Jan 12 (UNI) Allahabad High Court has ruled that the senior most doctor should be posted as Chief Medical Officer (CMO).
A division bench comprising Justices Amitava Lala and Sanjoy Mishra passed this order on a writ petition of Anil Kumar Agrawal.
The petitioner was transferred from the CMO's post to the post of Nagar Swasthya Adhikari.
The bench has ignored the personal affidavit filed by Uttar Pradesh principal secretary, medical and health, wherein it was said only doctors of joint director level could be posted as CMO, irrespective of seniority.
The petitioner had challenged the transfer order on the ground that he was senior to a person, who had been given charge of CMO.
His plea was that under government order only the senior most doctor falling in category one of doctors will be appointed as CMO.
The standing counsel had opposed the plea on the ground that two category of doctors have been prepared. In category one, there are 505 posts and category two 788 posts.
The bench quashed the transfer order indicating to the government to make appropriate policy to avoid future litigation.
