SC refuses to cancel the UP Civil Judge Tests 2003

New Delhi, Jan 9 (UNI) The Supreme Court today declined to set aside the selection of 347 Civil Judges (Junior Division) conducted by the Uttar Pradesh State Service Commission(UPSSC) in 2003 holding that the Commission has acted bonafide and neither the state High Court nor the state government has any grievances regarding the selection of the candidates.

A bench comprising Chief Justice Y K Sabharwal and Justices C K Thakker and R V Raveendran, however, held that the system of scaling adopted by the commission is unsuited in regard to Civil Judges (Junior Division) examination and directing moderation , will be prospective in its application and will not affect the selections and appointments already made in pursuance of 2003 examinations.

In regard to the 17 petitioners in the Supreme Court who were not selected, the apex court has said where the raw aggregate marks in the written examination and interview of any petitioner are more than that of the last selected candidate, he or she shall be entitled for being appointed against a future vacancy but whose raw marks are less than the last selected candidate shall not be entitled for appointment in future vacancy.

The relief will be available only to those who had approached before August 31,2005 this court or the high court and not to others.

The appointments of 347 out of 1290 candidates interviewed was made on the basis of 'scaled marks ' in written test.
