Lucknow, Jan 4 (UNI) Nithari killings have again brought Raj Bhawan and the Mulayam Singh Yadav government at loggerheads with the ruling Samajwadi Party questioning the authority of the Uttar Pradesh governor to send a letter suggesting a CBI probe into the incident.

Senior SP leader and Lok Sabha member Beni Prasad Verma addressing a press conference here said the governor had no right to send any letter to the CM to consider a CBI probe in any case.

''As a democratic head, the CM is responsible for any decision and if he thinks that there is no need for a CBI probe then no one can question his authority,'' he said.

Mr Verma said the act of the governor was condemnable and it shows Raj Bhawan was working on the directive of the Congress.

Earlier, sources had confirmed to UNI that Mr Rajeswar had sent a letter to CM suggesting CBI probe into the Nithari incident. The Governor wrote the letter following reports that the victims could have been killed for human organ trafficking.

The SP leader apprehended that by sending two separate investigative teams to Nithari by the Centre, it is conspiring to impose President's rule in UP.

''The Centre can send any investigation team under Article 355 of the Constitution and later it can be clubbed with Article 356 to dismiss any government,'' he commented.

Mr Verma said the Centre was in a mood to impose President's rule in the state to dismiss a democratic government which will certainly boomerang for the Congress.

''If President's rule is imposed then the SP will benefit as the Supreme Court will not hold the Nithari incident as a breakdown of the Constitutional machinery to dismiss a democratic government,'' he claimed.
