Cabinet nod to signing of UN Convention on state immunities

New Delhi, Dec 28 (UNI) The Union Cabinet today gave its approval for the signing of the United Nations Convention on Jurisdictional Immunities of States and their Properties.

Adoption of domestic legislation, whereby the Courts would decide any claims for immunity, would do away with the need to approach the Central Government for permission in each case.

This would also prevent the Government becoming party to litigation proceedings when permission to sue is refused or is delayed.

Participation in the Convention would promote uniformity in State practice internationally as well as greater clarity in the legal position on the subject.

The Convention has been adopted after extensive consideration in the International Law Comission and the Legal Committee of the UN General Assembly over a period of several years.

As such, it incorporates rules which are generally acceptable to all countries.

''Once approved, the instrument of full powers will be obtained authorising our permenent representative to the United Nations to sign the Convention,'' an offical statement said.
