Birla says will move SC against Calcutta HC judgement

Kolkata, Dec 21 (UNI) The Birlas said that they will move the Supreme Court challenging the Calcutta High court's appeal bench order on Priyamvada Birla's 1999 will, their solicitor said today.

''Its a long war. The truth will prevail and the Birlas will come out as victorious,'' N G Khaitan, counsel for the Birla family, said.

After the High Court gave their judgement on Priyamvada Birla's will, Mr Khaitan told mediapersons that the two judge appeal bench of Calcutta High Court upheld the single bench order on Priyamvada Birla's will of 1999.

In March 2005, Justice Kalyan Jyoti Sengupta had passed a similar order, denying the right of the three senior members of the Birla family, K K Birla, B K Birla and Yasovardhan Birla.

Mr Khaitan said that the apppeal bench comprising justice T K Dutta and Justice P Ghosh also dismissed an appeal of auditior R S Lodha, praying for rejection of the cavetable interest of G P Birla.

Both the single bench and appeal bench had allowed G P Birla's cavetable interest in the court. ''We question the veracity of the will as no member of the Birla family has been chosen as executor of the will, which is a mystery to us,'' Mr Khaitan said.

Mr Lodha is the only executor of the will.

Hailing the verdict, Mr Lodha's camp said the truth was coming out.'' Mr Debanjan Mandal of 'Fox and Mandal' who represented Mr Lodha in the court, said that the court had ruled that the three senior members of the Birla family could not not contest the case.'' UNI XC BA VD HT1815
