Kerala HC rejects election petition against Varkala Kahar MLA

Kochi, Dec 18 (UNI) The Kerala High Court today rejected an election petition filed by defeated CPI-M candidate S Sundaresan against Congress nominee Varkala Kahar, who won the 2006 assembly election from the Varkala constituency.

Justice Thottathil B Radhakrishnan rejected the petition after holding that it did not disclose a cause of action to be proceeded with and tried.

Contending that the election of Mr Varkala Kahar was void under the various provisions of the Representation of People Act 1951, the petitioner alleged that the respondent, who was the sitting MLA, had made elaborate arrangements in advance for manipulation in the voters list.

The court observed that the contentions of the petitioner were vague and not a single specific case of deletion or addition of names in the electoral rolls was pleaded.

The court also observed that there is no provision in the 1951 Act that enables the high court to set aside the election on the ground of any defect in the electoral roll.
