Judge reserves orders on BCCI meeting
Chennai, Dec 14 (UNI) Madras High Court today reserved orders for tomorrow on a petition seeking to restrain the Board of Control for Cricket in India (BCCI) from conducting any meeting.
Justice M S Chitra Venkatraman reserved the orders after hearing elaborate arguments from both sides on a suit filed by the Cricket Association of Bengal (CAB) which also sought to declare Rule 27, 38 (IV) and Rule 41 of the BCCI Rules as ultra vires of the Tamil Nadu Societies Registration Act, 1975.
When the suit came up for hearing this morning after a court directive, Senior Counsel P S Raman, appearing for the BCCI, produced the records pertaining to the registration of the amendments to the BCCI by-laws.
He submitted that when the amendment was brought in the year 2000 at a meeting held in Chennai, the then BCCI Chief Jagmohan Dalmiya and CAB participated, discussed and passed the amendment.
The amendments were passed unanimously. The Tamil Nadu Societies Registration Act, 1975 did not provide how many members should be there in the meeting for taking a decision on disciplinary action.
Hence, the 2/3rd majority prescribed under the BCCI By-laws will suffice, Mr Raman contended and prayed the court to allow the conduct of the meeting scheduled for December 16.
After the conclusion of arguments from the both sides, the judge reserved orders on the suit for tomorrow.
