Private bus owners can employ their own employees: H C

Kolkata, Dec 13 (UNI) Calcutta High Court today ruled that private bus owners could not be forced by trade unions to employ drivers and conductors of their vehicles.

The two-judge bench, presided by Chief Justice V S Sarpurkar, observed that bus owners have the sole right to choose employees to run their vehicles and no organisation has any say in the selection process.

The bench also said trade unions or any group of bus drivers and conductors have no right to file appeal against a decision of the bus owners.

The court passed the ruling on an appeal filed by a group of bus drivers and conductors challenging a single bench order which over ruled their right to get employment in any private bus against the will of the transport operators.

Sources said that these group of litigating bus employees was supported by CITU, the trade union arm of the CPI(M).

Earlier, the single bench of the court passed a similar order negating the other's options in selection of employees of private buses.
