HC dismisses PIL against Naresh Goyal

Mumbai, Dec 10: The Bombay High Court recently dismissed a public interest litigation (PIL) filed against the chairman of Jet Airways, Mr Naresh Goyal, which alleged that he had links with underworld don Dawood Ibrahim and Chota Shakeel and this nexus could jeopardize national security.

A Division Bench comprising Chief Justice H S Bedi and Justice V M Kanade held that while the petitioner, Dr M Furquan, had complained about the alleged nexus to the state's investigating agencies, he had not given them enough time to take action.

The bench further stated in it's order that though the allegations were serious and had wide ramifications, the PIL was currently being dismissed with leave to file a further application if no action was taken in a reasonable period of time.

Advocate for the petitioner, Mr K T Thomas told UNI that on an earlier occasion a similar petition had been dismissed on October 5, by a division bench of Justice R M Lodha and S A Bobde as they could not order the Central Bureau of Investigation to inquire into the matter when no proper complaint had been filed against Goyal.

Then the petitioner lodged a complaint and filed a fresh PIL when no action was taken on his complaint.

''But the court's order of November 30 allows the petitioner to pursue the complaint against Goyal through a fresh PIL if the investigating agencies do not take appropriate action,'' advocate Thomas pointed out.
