Judiciar has powers to review law passed by Parliament: BJP

New Delhi, Dec 7 (UNI) The BJP today said the Judiciary has inherent powers to review the enactment of Parliament but said it should restrain itself from stepping into the implementation part also.

Asked for the BJP's reaction on the debate involving the powers, duties and responsibilities of the the three pillars of democracy, BJP Parliamentary Party Spokesman Vijay Kumar Malhotra said the Constitution had empowered the Judiciary to review the laws when the legislature went wrong and pointed out to the quashing of IMDT Act in Asom, nullifying the Muslim reservation in Andhra Pradesh by the Supreme Court. ''They have the powers to quash or interpret any law passed by Parliament and nobody can question that power.'' However, the BJP had reservations when the Court stepped into the implementation aspect also like in the case of setting up Court's own Monitoring Committees to implement its orders on sealing of business establishments. ''The responsibiltity should be left to the Executive and if they fail, they should be hauled up for contempt,'' he said.
