HC asks UP to file counter affidavit
Allahabad, Dec 7 (UNI) The Allahabad High Court today asked the state government and legal remembrance state of Uttar Pradesh to file their counter affidavits on a writ seeking appointment as state Law Officer (Standing Council/Additional Advocate General) in HC under the reservation quota provided to handicapped persons.
The Bench comprising Justices Yatindra Singh and Ran Vijai Singh passed the order on a writ filed by Animesh Chatterjee, advocate and ex-president of the HC Bar Association.
Senior advocate V C Mishra, alongwith Mr Dinesh Rai appearing on behalf of the petitioner and said that their clinet, who is practicing as advocate since 1989 is physically handicapped and it is not possible for him to walk from one court to another.
They further submitted that under the UP Public Service (reservation for physically handicapped, dependents of freedom fighters and ex-servicemen) Act, 1993, one per cent reservation is provided to a physically handicapped person.
The office of the State Law Officer is a public office and thus, the petitioner be given appointment as state law officer under physically handicapped quota.
The Court after granting one month time to file counter affidavit has ordered to list this case after the expiry of time for the hearing.
