CPI for firm position by Parliament on judicial activism
New Delhi, Dec 7 (UNI) Senior CPI leader Gurudas Dasguta today made a strong case for Parliament to take a stand on ''judicial activism'' in the light of the supremacy of legislature and its rights to make laws.
Stating that he would bring a Private Members' Bill tomorrow on this issue, Mr Dasgupta said the move was necessitiated in the backdrop of the apex court's recent pronouncements on the workers' right to strike, Centre's notification on sealing drive in Delhi, Office of the Lok Sabha Speaker and similar other instances.
''I will cite more such examples tomorrow,'' the CPI leader said, when asked to elaborate.
In response to a query relating to the ''inaction'' on the part of the legislature in solving the sealing crisis in the national capital, he said this was as much a threat to our democratic edifice as judicial activism.
''If the executive has failed in certain respects, it does not mean that the judiciary would take over the job of the executive, the CPI leader said, adding that ''one negation of responsibility does not justify the other one.'' UNI Ksa V D KP1815
