Bharti Yadav moves Delhi HC over Neelam Katara's presence

New Delhi, Nov 24 (UNI) Bharti Yadav today moved the Delhi High Court challenging a lower court's order quashing her application seeking the deceased Nitish Katara's mother Neelam Katara,s absence from the court during her deposition scheduled on November 29.

Bharti's testimony holds key to prosecution case accusing her brother Vikas Yadav of having kidnapped Nitish Katara and killing him.

Dismissing Bharti Yadav's plea yesterday, Additional Sessions Judge Ravinder Kaur had said,"I do not find any substance in the application of Bharti to keep Neelam Katara out of the court during her deposition." In her application, Bharti had said the presence of Neelam Katara in the court during the recording of her evidence would cause prejudice to her and she would feel uncomfortable.

On another application by the prosecution for examination of - Nitin Katara's statements against Vikas Yadav and Vishal Yadav, the court said it would take up the plea for consideration on November 27.

The court also allowed a plea by the prosecution to interview Bharti before her examination in the court.

Ms Kaur said during questioning her by public prosecutor in the case B S Joon, Bharti's counsel would also be present.

Vikas Yadav and Vishal Yadav, brother and cousin of Bharti respectively, are facing trial in the case for allegedly kidnapping Nitish Katara, and later killing him because they were allegedly against their sister having an affair with him.
