Court rejeects Bharti's plea to bar Nitish's mother's presence

New Delhi, Nov 23 (UNI) A court here today dismissed the petition of Bharti Yadav, prime witness in the Nitish Katara murder case, seeking that his mother be barred from being present in the court when she testifies.

Additional Sessions Judge Ravinder Kaur said Ms Neelam Katara, Nitish's mother and also the complainant, had ''every right'' to know the whereabouts of the witness and assist the court during her deposition.

Justifying Bharti's demand to depose in camere, Ms kaur said that ''it would meet the needs of justice'' to record her testimony in camera excluding the media and public from having access to the court room where day-to-day proceedings would take place.

The three-page order said keeping in view the peculiar circumstances of the case and the sensitivity of the matter, it was necessary for the court to ensure that Bharti Yadav, deposed in an atmosphere which was free from any influence or pressure from the media or public.

The Court, on November 20, had ruled that the deposition of Bharti Yadav, the daughter of former Rajya Sabha member D P Yadav, would be held in camera on November 29.

Bharti, a student in the United Kingdom, is expected to come to India to depose before the court.

Bharti's brother Vikas Yadav and her cousin Vishal Yadav were accused of murdering Nitish after abducting him from a marriage party from Ghaziabad in Uttar Pradesh in February 2002.
